Food and Drink Victoria Ltd tickets the majority of their events (including Melbourne Food and Wine Festival and Drink Victorian, collectively termed the “Event”) using a third-party platform, Ferve Tickets. In many instances, the venue will ticket the event direct through their own online booking system or telephone booking. The booking method is noted on each event page and any tickets purchased through an external ticket provider are subject to their terms and conditions.
These terms and conditions govern access to an Event for which tickets are supplied directly by Food and Drink Victoria Ltd.
By purchasing a ticket or registering for an Event ticketed by Food and Drink Victoria Ltd, you agree to be bound by these terms and conditions as amended from time to time.
1. Advertised Ticket price
1.1. The advertised ticket price is:
a) inclusive of GST and a per ticket fee;
b) exclusive of a credit card fee; and
c) in Australian Dollars (AUD).
1.2. A credit card fee of no more than 1.65% per transaction will be applied for credit card transactions, and a booking fee of not more than $4.50 per booking.
1.3. A credit card fee/booking fee does not apply when purchasing a ticket with cash at an Event.
1.4. Please note that the ticket price does not include any travel or accommodation costs unless explicitly stated within a ticket package.
2. Gift Vouchers
2.1 Gift Vouchers:
a) are treated as cash and cannot be replaced if lost or stolen;
b) are valid for three years from the date of purchase; and
c) cannot be returned or transferred (whether in whole or in part) for cash.
2.2. The value stated on the gift voucher (or remaining on the gift voucher after partial redemption) is expressed inclusive of GST.
2.3. Any purchases which exceed the value of the gift voucher will require the holder to pay the difference in price using another form of tender.
2.4. No change will be given and any remaining balance will remain on the gift voucher to be used in whole or in part against future purchases of events (valid for three years from the date of purchase).
2.5. Any balance that remains on the gift vouchers after expiry will not be available for use.
3. Refunds
3.1 If you have purchased a ticket to attend an Event, subject to any statutory rights of refund (including, without limitation, the provisions of the Australian Consumer Law as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (“ACL”)) and unless otherwise specified in these terms and conditions, tickets purchased to the Event are generally non-refundable and are not available for exchange.
3.2 Complimentary tickets or zero value registrations are not given refunds.
4. Weather conditions
4.1 Outdoor events are subject to adverse weather conditions. Patrons accept the risk that weather may impact the event and acknowledge that tickets will not be refunded or exchanged for a gift voucher, except to the extent otherwise required by law.
5.1 An Event’s content and program is accurate at the time of printing and online. F+DV may make changes to an Event as required, however will use reasonable efforts to provide a program and content of equivalent standard. To the maximum extent permitted by law, F+DV reserves the right at any time to:
a) change the format, speakers, program participants, content, location, venue and timing or any other aspect of an Event;
b) postpone the Event or any part of the Event; or
c) cancel the Event or any part of the Event.
5.2 Should F+DV be required to cancel an Event, F+DV will provide as much notice as possible to all confirmed attendees and presenters and this may be updated or reflected on the website by F+DV as soon as it is possible. Attendees and presenters will also be contacted by email.
5.3To the maximum extent permitted by law, F+DV is not liable for the actions, representations or information provided by speakers or presenters at an Event, and such views and opinions expressed by the speakers or presenters do not necessarily reflect the views and opinions of F+DV.
6. Your obligations
6.1 By purchasing a ticket or registering to attend an Event, you:
a) warrant that your details as provided are true and correct;
b) agree to comply with all laws, government directives, orders and regulations relevant to the Event, in place at the time of the Event;
c) agree to comply with any particular conditions, rules, regulations or usage requirements of the venues or of F+DV in connection with an Event;
d) agree to comply with all lawful and reasonable instructions issued by F+DV or the operator of the venues for the Event including whilst at, entering, or departing the venue (including without limitation in respect of an acceptable noise level emanating from the venue spaces); and
e) agree to behave in an appropriate manner at all Events consistent with the law.
6.2 To the maximum extent permitted by law, F+DV reserves the right, without any liability, to refuse to accept your registration, refuse admission to, or to eject you from the Event, in its absolute discretion, including (without limitation), for failure to comply with these terms and conditions or if in the opinion of F+DV or the operator of the venues for the Event, you represent a security risk, nuisance or annoyance to the running of the Event.
6.3 You agree not to resell your ticket without the written pre-approval of F+DV.
6.4 If you are accompanied by a minor(s), you are responsible for the care, acts or omissions and supervision of those minors at all times.
6.5 You must carry a valid photo ID (current Australian Driver’s licence, current passport or current state/territory issued photo identification) as proof of age and you may be required to present this upon entry and at any other time upon the request of F+DV or the operator of the venues for the Event.
6.6 Whilst at the Event, you must take care to protect your own property from loss and damage and take steps to prevent your property causing safety issues or damage to other people or property. You also attend the Event, use the venues for the Event and all associated facilities at your own risk.
6.7 To the maximum extent permitted by law, F+DV and its officers, employees, agents, volunteers, contractors and sub-contractors (“Representatives”) will not be liable for any claim, damage, compensation, loss or expense (including any direct, indirect or consequential loss or damage) to any property brought to an Event by you and/or that may be suffered or incurred in relation to your attendance at an Event.
7. Liquor
7.1 You are advised that:
a) alcohol may only be consumed by persons over the age of 18 with valid identification documentation within designated licensed areas at the venues;
b) bringing your own (BYO) alcohol is strictly prohibited;
c) intoxicated persons will not be permitted to enter the venues;
d) intoxicated persons will be removed from the venues at the discretion of the venue or F+DV. It is an offence for minors to purchase or consume alcohol and an offence to sell to or supply minors with alcohol; and
e) penalties under the Liquor Control Reform Act 1998 (Vic) apply.
8. Accessibility/Dietaries
8.1 It is your responsibility to inform F+DV or the Event venue of any special dietary or other requirements you may have, sufficiently in advance to enable F+DV to attempt to accommodate these requirements (or where this is not possible, inform you of such).
8.2 Each Event will state whether it allows dietaries or has accessibility. It is possible to search on the website for dietary requirements and wheelchair access to Events via the program. In rare cases if an Event cannot cater for dietaries or wheelchair accessibility, this will be noted on the page.

9. Capture and use of image
9.1 You consent to being photographed, filmed and recorded at the Event. You also consent to the use of any film, image, likeness or recording of you at the Event, at the discretion of F+DV, by F+DV, the Event venue operator, commercial partners, media agencies, and law enforcement agencies, for any purpose and without compensation or further notice.
10. Privacy

11. Medical assistance and information
11.1 You authorise F+DV, and the Event venue, its medical contractors and any other third-party medical service providers at the Event to administer any medical assistance, treatment or transport you seek, or as is reasonably necessary in the circumstances (the costs of which you may be responsible for). In connection with any such assistance, you consent to the disclosure of your personal information and relevant medical details to F+DV, its insurers and other relevant third parties.
12. Interpretation
12.1 These terms and conditions shall not exclude, restrict or modify the application of any provision of the ACL where to do so would contravene the ACL.
12.2 If any provision or part of a provision of these terms and conditions is held or found to be invalid or unenforceable at law, then it shall be read down to the minimum extent necessary to achieve its validity or enforceability or otherwise severed from these terms and conditions without invalidating or affecting the remaining clauses in these terms and conditions.
12.3 F+DV reserves the right to amend these terms and conditions from time to time by giving you notice (by email or by posting it on F+DV’s website).
12.4 These terms and conditions are governed by the laws of the State of Victoria, Australia.
